Challenging a Deportation Order in Turkey – Edirne

A deportation order is an administrative decision taken by the governor’s office, and it is subject to judicial review. The deadline to challenge it is only seven days. This page summarises the steps to take in the first days after the order is served.

The first 48 hours after the order is served

  1. Keep the order and the notification document. A photo is enough. The date of notification is the start of the seven-day period.
  2. Identify the legal ground of the order. Deportation orders are based on the grounds listed in Article 54 of Law No. 6458 (for example, overstaying a visa or residence permit, working without a work permit, or public order). The ground relied on determines what has to be argued in the case.
  3. Find out where the person is. The order is often issued together with administrative detention, and the person is taken to a removal centre. The remedy against administrative detention is different from the case against the deportation order.
  4. Speak to a lawyer and plan the power of attorney. Issuing a power of attorney for a person held in a centre can take time; because the deadline is short, this step should not be delayed.

What the court examines

The administrative court examines whether the order is based on a ground listed in the Law and whether it is proportionate. The petition usually addresses:

  • Whether the fact on which the order is based actually exists (for example, whether the permitted stay was really exceeded)
  • The person’s family ties in Turkey, the situation of any children and the length of the stay in Turkey
  • Whether there is a risk of the death penalty, torture or inhuman or degrading treatment in the country of return (Article 55 of the Law provides that no deportation order may be issued for such persons)
  • Personal circumstances such as health, age and pregnancy

The process in Edirne

A case against a deportation order issued in Edirne is filed with the administrative courts in Edirne. If the order was issued by the governor’s office of another province, the case is heard by the administrative court in that province; the fact that the person is held at a centre in Edirne does not change this.

Frequently asked questions

When does the seven-day period start?

The period starts on the date the deportation order is notified to the foreign national, their legal representative or their lawyer. Establishing the correct date of notification can therefore decide the outcome of the case.

Does filing a case stop the deportation?

Yes. Unless the foreign national consents to leave, they are not deported during the period for filing a case or, if a case is filed, until the proceedings are concluded. Since Article 53 was amended by Law No. 7533 of 21 November 2024, this applies whatever ground of Article 54 the order is based on. The person may remain in administrative detention during this time; detention is challenged separately before the criminal judgeship of peace.

Is there a remedy against the administrative court’s decision?

In a case against a deportation order, the administrative court’s decision is final. If there is a serious risk to the person’s right to life or a risk of ill-treatment, an individual application to the Constitutional Court, together with a request for an interim measure, can be considered.

Can a deported person come back to Turkey?

As a rule, an entry ban is also imposed on foreign nationals who are deported. The length of the ban and whether it can be lifted require a separate assessment; see our page on entry bans.
